If a company is degrading an area by drilling, is it OK for it to make up for it by improving the environment elsewhere?

Offsite Mitigation for oil or natural gas drilling

A memo entitled Interim Offsite Compensatory Mitigation for Oil, Gas, Geothermal and Energy Rights-of-Way Authorizations" was issued in February this year by the Bureau of Land Management (BLM). According to it, mitigation measures are ways to "prevent unnecessary or undue degradation of the public lands and protect surface resources in the approval of surface use plans". There are several methods of mitigation and it concerns itself with just one, "Compensating for the impact by replacing or providing substitute resources or environments". The new policy document was issued because of popular demand.

The new policy, which is subject to review, is: "The BLM will approach compensatory mitigation on an “as appropriate” basis where it can be performed onsite and on a voluntary basis where it is performed offsite. Further, this IM is not intended to establish an equivalency of mitigation policy by the BLM (i.e. acre for acre)". It covers oil, gas, and geothermal authorizations and energy right-of-way authorizations (including oil and gas pipelines, electric transmission lines, and wind and solar energy). Onsite mitigation will always be preferred.

One interesting point is that, "When an applicant’s offsite mitigation proposal is part of the plan of development for an approved permit or grant, that mitigation will pass from being a voluntary proposal to becoming a requirement of the authorization. The applicant becomes committed to the offsite mitigation component once the authorization is granted." So the BLM cannot force companies to offer offsite mitigation, but if they do offer it and it is accepted, it becomes mandatory. Of course, if it is not offered the BLM can turn down the application if the total mitigation is not deemed adequate. Also, if one applicant has volunteered offsite mitigation, the BLM may negotiate for it with neighbouring applicants.

There may be Endangered Species Act Section 7 consultation with the U.S. Fish and Wildlife Service. If so, any resultant mitigation measures developed are not affected by the new policy. The BLM’s National Historic Preservation Act (NHPA) Section 106 responsibilities must also be taken into account.

If it is not practical for an applicant to manage specific mitigation efforts, because more than one applicant would be involved, the BLM make accept money to be used on on-the-ground projects instead.

U.S. Make Drilling Compensation Voluntary

The US Bureau of Land Management, dealing with record numbers of applications to drill for oil or natural gas, has made "offsite mitigation" - improving the environment to compensate for oil and gas development - voluntary.
