A firm I freelance for has a client that "mandates" that she be given the audio for every deposition, transcribed or not.  I'm not comfortable with providing it at all, much less an untranscribed depo.

What do you all think?

I should add that I'm aware of NCRA's opinion, Public Advisory Opinion 38.

My issue is with the firm requiring the reporter to supply the audio, transcribed or not.

Stephanie,

I'd like to know the reason the attorney wants the recording.  What if the reporter doesn't use audio synch or a backup recording?  Assuming there's no law against it in your state, why doesn't the attorney just record it herself?

Well, I certainly wouldn't provide it for free. The client can record it herself for free. If you provide a service, you should also provide a fee. If you want to be nice to a favored client, though, I suppose you could provide it for free with a paid-for copy of the transcript.

Are these depos or examinations under oath for an insurance company of some sort?

Tim,

These are just typical transcripts, but because this client often generates 0/4 when she does order, she expects free audio on the untranscribed depos.  And, the firm owner is very willing to provide the audio.  I'm inclined to ask not to be assigned to her depos because I don't want to do anything I feel is unethical.  If she gets it free, then so should the other side, right?  Where does that leave the reporter?  With no transcript and no chance of being paid for the audio. Not with this firm, anyway.  As far as I'm concerned, they can all bring their own audio equipment, or just videotape it.

Good question.  I don't know, but she's such a "good" client according to the firm owner, that they're willing to bow.

I should think so. Unless you (and the reporting firm) want to show partiality...

Probably your only real solution. It does, of course, mean a drop in income, and depending on how they deal with the issue, potentially a loss of all overflow work from the agency.
